Worker’s Compensation Exemption


What is an Exemption?

The purpose of obtaining an exemption is for an officer of a corporation or member of a limited liability company to exclude themselves from the worker’s compensation laws.

Upon issuance of an exemption, the officer or member is no longer an employee of the business and may not recover worker’s compensation benefits.

Requirements for All Exemptions

The corporation or LLC must be registered and listed as active with the Florida Department of State, Division of Corporations.

Applicant must have a Driver license from any State or a Florida Identification Card.

Applicant cannot be affiliated with an active stop-work order (SWO) or working in violation of a SWO.

Construction Industry Requirements

Applicants must attest to a minimum 10% ownership of the corporation or LLC.

No more than 3 officers of members may elect to be exempt.

Application Processing fee plus service fees apply.

Exemptions are valid for 2-year period

Exemptions are not transferrable
